Harmonization of digital rights

Abstract

In the current context, the protection of personal data has become increasingly relevant, particularly in the face of the challenges posed by the use of emerging technologies such as artificial intelligence (AI) and big data (BD). Therefore, this systematic review study aims to analyze the most effective mechanisms to guarantee the right to the protection of personal data (PDP) in the digital environment, considering the implications and thematic gaps that persist in the matter. The research identified three significant thematic gaps. First, it highlights the need to deepen the development of effective regulatory and governance mechanisms to address the risks and threats that AI and BD pose to the protection of personal data. Second, it identifies the challenges related to the effective implementation of the right to digital oblivion, conceived as a fundamental mechanism to safeguard privacy and reputation in the online environment. Finally, the importance of achieving harmonization between digital rights and the protection of other fundamental rights, such as freedom of expression and privacy, in the context of the use and expansion of new technologies, is emphasized. The methodology used in this article was through a systematic review of the literature, using the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) method, which allowed a comprehensive analysis of the scientific evidence available on these issues, highlighting both the progress achieved and the limitations existing in the field of study. The results obtained show the complexity and relevance of the problems addressed, as well as the need to continue deepening this line of research through empirical studies, comparative analyses and interdisciplinary approaches.
